Privacy Policy
1. Introduction
This policy explains how Omnuvar handles personal information about people who visit this website or hold an account with us. It is written to meet the Personal Information Protection and Electronic Documents Act (PIPEDA), and, where they apply to you, Quebec's Act respecting the protection of personal information in the private sector (as amended by Law 25) and the personal information protection acts of Alberta and British Columbia.
By using this site or opening an account you accept the practices described here. If you do not agree with them, please do not submit information to us.
2. Information we collect
We collect only what we need for the purposes set out in section 3:
- Identifying information you give us: name, email address and telephone number submitted through a form on this site.
- Verification information required to open an account, including date of birth, residential province and government-issued identification.
- Account and transaction records, including funding, orders placed by the engine and resulting positions.
- Technical information collected automatically: IP address, approximate location derived from it, browser and device type, and the pages you viewed.
- Marketing attribution parameters carried in the link you arrived through, where present.
3. How we use your information
We use personal information to open and administer your account; to verify your identity and meet our obligations under anti-money-laundering and record-keeping law; to execute and report on trading activity; to answer your questions; to secure the platform and detect fraud; and to improve the service. We do not sell personal information.
4. Consent
We collect, use and disclose personal information with your knowledge and consent, except where law permits or requires otherwise. The form of consent we seek reflects the sensitivity of the information: express consent for identity and financial information, implied consent for information you volunteer for a purpose that is obvious in context.
You may withdraw consent at any time, subject to legal and contractual restrictions and reasonable notice. Withdrawing consent for information we need to administer an account may mean we can no longer provide the service.
5. Safeguards
We protect personal information with safeguards appropriate to its sensitivity: encryption in transit and at rest, access limited to staff who need it for their role, mandatory two-factor verification on account changes and withdrawals, logging of administrative access, and independent security review each quarter.
No system is perfectly secure. If a breach creating a real risk of significant harm occurs, we will notify affected individuals and the Office of the Privacy Commissioner of Canada as required by law.
6. Service providers and disclosure
We share personal information with service providers who perform functions on our behalf — identity verification, payment processing, hosting, customer-relationship management and analytics — under contracts that limit their use of the information to those functions.
We may also disclose personal information where required by law, to comply with a court order or regulatory demand, or to investigate suspected fraud or a breach of our terms.
7. Transfers outside Canada
Some of our service providers process or store information outside Canada. While information is in another jurisdiction it may be accessible to the courts, law enforcement and national security authorities of that jurisdiction. We assess each provider before transfer and require comparable protection by contract. You may write to our Privacy Officer for information about where your data is held.
8. How long we keep information
Account and transaction records are retained for the period required by financial record-keeping law, which is generally seven years after the account relationship ends. Enquiry records that do not lead to an account are retained for twenty-four months. Technical logs are retained for twelve months. When a retention period ends, information is deleted or irreversibly anonymised.
9. Your rights
You have the right to ask what personal information we hold about you, to receive an account of how it has been used and to whom it has been disclosed, and to have inaccurate information corrected. Where Quebec law applies to you, you also have the right to receive computerised personal information you provided in a structured, commonly used technical format, and to ask that information be de-indexed in defined circumstances.
Write to our Privacy Officer at [email protected]. We respond within thirty days. If you are not satisfied with our response you may complain to the Office of the Privacy Commissioner of Canada or, in Quebec, to the Commission d'accès à l'information.
10. Cookies and similar technologies
This site uses a small number of cookies. One caches cryptocurrency price data for twenty-four hours so the ticker does not re-request it on every page view. Others record marketing attribution where you arrived through a campaign link. We do not use cookies to build advertising profiles across unrelated websites.
Your browser can refuse or delete cookies. The site remains usable if you do, though the price ticker will fetch fresh data more often.
11. Commercial electronic messages
We send commercial electronic messages only in accordance with Canada's Anti-Spam Legislation. Every such message identifies us, gives contact information valid for at least sixty days, and carries a working unsubscribe mechanism that takes effect within ten business days. Service messages about your account are not marketing and continue regardless of your marketing preferences.
12. Minors, changes and contact
The platform is not offered to anyone below the age of majority in their province or territory, and we do not knowingly collect information about them. If we learn we have, we delete it.
We may update this policy. Material changes will be posted here with a revised date above, and where the law requires it we will seek fresh consent. Questions, requests and complaints go to our Privacy Officer at [email protected].
